These Terms and Conditions (“Terms”) govern all sales of goods and services, installations, and website usage by Deco Shield Inc. (“DSI,” “we,” “us,” or “our”). By accessing our website, purchasing products, or using our services, you agree to be bound by these Terms.

1.1 Acceptance of Terms

2. General Terms and Conditions of Sale and Services

2.1 Formation of Contract
A contract (“Contract”) between Deco Shield Inc. and the customer (“Customer”) is established upon acceptance of DSI’s written or electronic quotation (“Offer”) by the Customer. The Contract incorporates these Terms, which take precedence over any other terms proposed by the Customer.

2.2 Prices and Payment
Prices quoted are in Canadian dollars and are subject to applicable taxes. Full payment is due as per the terms stated in the Offer or invoice. Failure to make payment on time may result in suspension or cancellation of services.

2.3 Delivery and Performance
Delivery dates and installation schedules are estimates only. DSI will make reasonable efforts to meet agreed timelines but shall not be liable for delays due to causes beyond its control, including weather conditions, supply shortages, or access limitations.

2.4 Customer Obligations
The Customer agrees to provide clear access to the installation site and ensure safe working conditions. Failure to provide adequate access or preparation may result in rescheduling fees or cancellation under DSI’s cancellation policy.

2.5 Limitation of Liability
To the fullest extent permitted by law, DSI’s total liability for any loss or damage arising from the Contract shall not exceed the total amount paid by the Customer. DSI shall not be liable for indirect, consequential, or incidental damages, including loss of profits, arising out of the installation or use of the products and services provided.

2.6 Force Majeure
DSI shall not be liable for any delay or failure in performance caused by events beyond its reasonable control, including acts of God, strikes, fire, flood, or government restrictions.

2.7 Cancellation and Rescheduling
Cancellations must be submitted in writing at least 48 hours before the scheduled installation. Late cancellations may incur a service fee.

3. Installation Terms and Conditions

3.1 Scope of Work
These Installation Terms apply to all goods and services provided by Deco Shield Inc., including the supply and installation of residential and commercial security film, window film, and other protective materials.

3.2 Preparation of Premises
Before installation, the Customer must:
(a) Remove all blinds, curtains, brackets, or obstacles from installation areas.
(b) Ensure windows and doors are clean and free from grease, dirt, or adhesives.
(c) Provide unobstructed access to all windows and doors.
(d) Deactivate any connected alarm systems.

If DSI must remove or reinstall window treatments, alarm components, or other items, it will not be responsible for resulting damage or reinstallation.

3.3 Installation Standards
All window film installations are performed in accordance with the International Window Film Association’s Visual Quality Standard for Applied Window Film.

3.4 Post-Installation Care
To maintain warranty coverage, the Customer must:
(a) Avoid cleaning the installed film for 30 days post-installation.
(b) Use only soft cloths and approved cleaning products (e.g., Windex).
(c) Avoid abrasive materials, ammonia-based cleaners, or razor blades.
(d) Prevent contact with sharp objects that may damage the film.

3.5 Drying Period
Installed film requires a drying period of approximately 60 to 150 days. Minor haziness or small bubbles during this period are normal and will dissipate as moisture evaporates.

3.6 Safety and Hazards
If unsafe conditions arise during installation, DSI reserves the right to withdraw personnel and reschedule the work. Additional charges may apply for interruptions caused by unprepared or unsafe premises.

3.7 Compliance with Law
The Customer is responsible for obtaining any necessary municipal or building permits related to the installation.

4. Warranty Terms

4.1 Manufacturer Warranty
All eligible window films installed by Deco Shield Inc. are covered under Madico’s Manufacturer Warranty for quality and performance. Warranty terms vary depending on the specific film and application type.

4.2 Conditions of Warranty
Warranty coverage is valid only if the installation was completed by Deco Shield Inc. and the Customer has adhered to all installation and maintenance requirements stated herein.

4.3 Warranty Claims
In the event of a warranty claim, DSI will assist the Customer in coordinating with Madico for evaluation and resolution under the manufacturer’s policy.

5. Governing Law

These Terms and all transactions between Deco Shield Inc. and the Customer shall be governed by the laws of the Province of Ontario and the laws of Canada applicable therein. Any disputes shall be subject to the exclusive jurisdiction of the courts of Ontario.
